1. Introduction

1.1. These terms and conditions ("Terms") govern the use of the OnlineWatt web portal ("Portal") and the services provided through this Portal. By using the Portal, you agree to these Terms in full.

1.2. The operator of the Portal is SUNNYCOLD s.r.o., with its registered office at Komenského 264/5, 500 03 Hradec Králové, Company ID: 28810911, VAT ID: CZ28810911 ("Operator").

2. Registration and User Account

2.1. To use the services of the Portal, it is necessary to register and create a user account.

2.2. Users are required to provide truthful, accurate, and up-to-date information during registration. Users are responsible for keeping their registration details current.

2.3. Users are responsible for the security and confidentiality of their user account and password.

3. Services and Payment Terms

3.1. The Portal offers monitoring of heat pumps and photovoltaic power plants through various subscription plans.

3.2. Payments for services are made through the Stripe payment gateway. When using this payment gateway, users are governed by Stripe's terms and conditions.

3.3. All prices listed on the Portal are final and include all applicable taxes unless explicitly stated otherwise.

3.4. Users agree that all payments for services are non-refundable unless specified otherwise in these Terms or by law.

3.5. The subscription is billed monthly or annually according to the chosen plan and will be automatically renewed until canceled by the user.

4. Cancellation and Withdrawal from the Contract

4.1. Users can cancel their user account and subscription at any time through the Portal interface or by contacting customer support.

4.2. The Operator reserves the right to cancel a user account without prior notice in the event of a breach of these Terms or the law.

5. Liability and Limitation of Liability

5.1. The Operator is not liable for damages resulting from the improper use of the Portal's services or technical issues.

5.2. The Operator is not responsible for the content and services of third parties accessible through the Portal.

6. Personal Data Protection

6.1. The Operator processes users' personal data in accordance with Act No. 101/2000 Coll., on the protection of personal data, and other applicable regulations.

6.2. Detailed information on personal data processing is provided in the Privacy Policy available at https://www.onlinewatt.cz/gdpr.

7. Changes to the Terms

7.1. The Operator reserves the right to change these Terms at any time. Users will be informed of changes to the Terms via the Portal or by email.

7.2. By continuing to use the Portal after the changes to the Terms have been made, users express their agreement with these changes.

8. Final Provisions

8.1. These Terms are governed by the laws of the Czech Republic.

8.2. Any disputes arising from these Terms will be resolved by the competent courts of the Czech Republic.

8.3. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
